Latest H-1B Count for FY 2010
The USCIS reports that as of August 28, 2009, approximately 45,100 H-1B cap-subject petitions have been received by the USCIS and counted towards the 2010 H-1B cap. Approximately 20,000 petitions qualifying for the advanced degree cap exemption had been filed. USCIS states that they will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach statutory limits.
As the annual cap is 65,000, it is not too late to submit a new H-1B petition. Whereas the past several years have seen the cap reached on the first possible days of filing, this year there are still almost 20,000 available slots.
