The USCIS reported today that as of December 11, 2009, approximately 62,900 H-1B cap-subject petitions had been filed.  The annual cap is 65,000.  Once the cap is met, employers cannot use the H-1B program for foreign nationals subject to the annual cap, until the next fiscal year.  The 2010-2011 fiscal year begins October 1, 2010.  Applications for the 2010-2011 fiscal year can be filed up to six months before the October 1st start date, or on April 1, 2010.
