Even More H-1B and L-1 Filing Fees

 August 19 - On August 13, 2010, a new law went into effect which dramatically increases H-1B and L-1 filing fees for medium to large-sized employers that employ a significant number of H-1B or L-1 employees. 

 The new law requires the submission of an additional fee of $2,000 for H-1B petitions and $2,250 for L-1A and L-1B petitions, if the employer: (1) employs at least 50 employees in the U.S., and (2) if at least 50% of the employees are in H-1B, L-1A or L-1B status.  

The additional fee only applies for (1) new H-1B or L-1 petitions, or for (2) new employers submitting a petition for an employee who already holds H-1B or L-1 status.

The USCIS is advising employers to either pay the fee when submitting the petition, or include an affidavit or statement explaining why the new fee does not apply.

This new fee is in addition to all the other filing fees.
